We may then suggest that a thorough investigation be undertaken in relation to your case, including a review of your medical reports and reports from treating doctors, and obtaining an independent medical expert's opinion.

We can advise you in relation to the following:

  • What type of claim you have and the merits of your claim.
  • What remedies may be sought, and in which court/forum.
  • Who should be sued - for instance, claims may be made against a referring general practitioner, a medical specialist, diagnostic services providers, the hospital, the company managing the hospital, an area health service, etc.
  • Who should give evidence - selection of the appropriate expert is critical.
  • The costs involved in mounting your claim - including legal costs, barrister's fees, and medical expenses - and liability for those costs.
  • The risks and other implications in making a claim - including the risks of paying the other side's costs if your claim ultimately is unsuccessful.
  • Whether there are statutory limitations in terms of making your claim - in most states and territories there are time limits within which proceedings may be commenced by a plaintiff.
  • Whether there are statutory requirements in relation to the making of the claim or the procedure to be following in making the claim.
  • How long will the claim is likely to take until it is resolved.
  • Possible out of court settlement of your claim.
