Claims for land tax paid between 1996 and 1999
- On 13 March 2001 DLS issued a report detailing differences in the valuations of 185 properties
in the Municipality of Woollahra between 1998 and 2000 made by the Valuer-General (VG) and a
private firm of valuers retained by DLS.
- The DLS Report was undertaken following the 1999 Walton Inquiry. Ms Julie Walton,
who headed the Inquiry, found serious deficiencies in the system of land tax administration
in NSW and the objection procedure under the land tax laws.
- The findings of the DLS Report are disturbing and indicate that there could have
been considerable over-valuation by the VG that could have cost these 185 owners up to $5.1
million over those three years.
- A summary of the DLS Report is set out below. It will be the subject of ongoing discussion
with the NSW Carr Government, which has so far refused to deal with the question of overcharging
of land tax between 1998 and 2000.
- Nonetheless we believe there is now a window of opportunity for land tax payers to
obtain an allowance or refunds of land tax overpaid for the period 1996-1999 or part thereof.
- Applications could be made for refunds and/or allowances in respect of any properties
on which land tax is paid - be they residential, commercial or industrial properties.
